PSEG provides this Privacy Policy because we know that you care about how your information is collected, used, shared, and retained. This Privacy Policy applies to information collected through the Site or through mobile applications released by PSEG. By visiting the Site, registering on the Site, or using the Services provided through the Site by PSEG or through mobile applications released by PSEG from time to time, you are consenting to our collection, use, disclosure, and retention of your information as set forth in this Privacy Policy. As a visitor you need not register or give any personal identification to use the Site. Unless otherwise stated, all defined terms shall have the meaning set forth in our Terms of Use.

Terms & Conditions
This Agreement is between you and Public Service Electric and Gas Company, a New Jersey corporation having offices at 80 Park Plaza, Newark, New Jersey 07102 (together, with its parent and affiliates, "PSE&G" or “us” or “we”) and governs your use of the PSE&G Skill on Amazon’s Alexa service on any Alexa-enabled device (the “Skill”). The Agreement applies in addition to, and is not intended to replace, any other agreement that may apply in connection with your accounts for services you receive from PSE&G ("Account(s)").
Before using the Skill, please read these Terms and Conditions, the PSE&G Website Terms & Conditions, the PSE&G Privacy Policy and the PSE&G Disclaimer (collectively, the “Agreement”).
Your use of the Skill is conditioned on your acceptance of this Agreement. If you don’t accept these terms, you may not use the Skill.
- Privacy and Security: The Skill allows you to use your Alexa-enabled device to communicate with PSE&G, by voice, regarding your Account(s). Your voice is only used to activate Alexa’s features and is not used to authenticate the account. To use the Skill, you will have to speak commands and questions aloud to Amazon’s Alexa service (“Alexa”), and you will receive responses aloud. Any communication to PSE&G via Alexa will be treated by PSE&G as a communication authorized by you, and any communication from PSE&G via Alexa in response to a request received from your Alexa-enabled device will be treated by PSE&G as a communication to you. In other words, you are responsible for all of the interactions with PSE&G via the Skill. For example, it is possible that someone other than you could interact with PSE&G via the Skill, or that someone could overhear you interacting with PSE&G via the Skill and learn information about your Account(s). (Try using your “inside voice.”) It is also possible that Alexa (and the equipment Alexa is installed on) and/or Amazon will record your interactions with the Skill or with Alexa. Consult your agreements with Amazon to learn more about how Amazon and your Alexa-enabled device treat those interactions.
- Release of Your Information to Amazon. By installing the Skill, you are authorizing PSEG to perform the actions and/or share with Amazon the information you communicate to PSEG (such as voice commands), or which PSEG may request from you. The interactions you have with the Skill take place through Amazon. For example, if you ask Alexa for any information pertaining to your Account, PSEG transmits the relevant information through Amazon. Therefore, you hereby authorize PSEG to share that information with Amazon in response to your interactions with the Skill.
- ACH Debit Authorization: One of the things you may be able to do on the Skill is pay your PSE&G Account balance. You will be given choices about how much to pay (e.g., total amount due or partial payment) and what bank account to use to make your payment. By using the Skill on your Alexa-enabled device, you authorize PSE&G to initiate payments in amounts up to your Account balance. The payment(s) will be initiated on the date(s) you direct Alexa to do so (“Payment Date”), but when you pay using ACH Debit, the timing of the withdrawal from your pay-from account (i.e., the checking or savings account that you use to pay down the bill) will be based on the pay-from account’s processing schedule. In other words, if you pay your PSE&G bill from your Bank X checking account, we’ll start the process when you ask us to (and it usually takes less than two days), but we can’t promise how long it will take overall because it depends on the timing of Bank X debiting your account and sending it to us.
- Third-Party Security Settings: Once you set up your Alexa device with the Skill, you are authorizing PSE&G to provide information to the device based on the device’s security settings. For example, the settings on your device may allow the device to retrieve information about your Account(s) based on only verbal requests from anyone who uses your device, or to save information about your Account(s) for easier access. By enabling the Skill on your Alexa-enabled device, you are responsible for how the Skill is used (including any communication to or from PSE&G from your device).
- Accuracy: We didn’t design or manufacture Alexa or your Alexa-enabled device. The device also runs other software (e.g., Alexa and other third-party apps) that we did not write or design and do not have control over. It’s possible that Alexa will not hear you correctly, will incorrectly translate what you said, or even say something to you different than the information we provided to Alexa. By accepting this Agreement, you understand and agree that PSE&G is not responsible for inaccuracies in your interactions with PSE&G via the Skill. If you have any issues or doubts about the accuracy of your interactions with PSE&G via the Skill, you can still get your Account details by logging on to your Account(s) on our website at www.pseg.com).
- Bugs: As with any application, it’s possible that there will be bugs. In addition to the possibility of Alexa mishearing you or misquoting us, there’s also a possibility that something might not work correctly, or might not work at all. By using the Skill, you’re accepting that risk. Again, you do not need the Skill to access your Account(s). All of the information available from PSE&G via the Skill is also available on our website (see “Accuracy” section, above). Don’t rely on the Skill as your sole means of accessing your Account(s).
- Electronic Records and Signatures: By accepting these terms, you consent to the general use of electronic records and signatures in our relationship with you.
- Hardware and Other Requirements: To access PSE&G via the Skill, you must (1) have an active residential Account that is in good standing, (2) be enrolled in PSE&G’s My Account, (3) be 18 years of age or older and a legal resident of the 50 United States or the District of Columbia, and (4) have an Alexa-enabled device, an internet connection, and an Amazon account. You cannot use the Skill otherwise.
- Contacting You: We may seek your constructive feedback on the Skill, including problems you encounter, aspects that work well, and suggestions for improving it. You agree that PSE&G may email you from time to time about your experience with the Skill.
- Changes or Amendments: We may change, suspend, or discontinue the Skill, or any part of it, at any time without notice. We may amend any of this Agreement's terms at our sole discretion by posting the revised terms on our website at PSE&G Skill on Amazon’s Alexa Service Terms & Conditions. Your continued use of the Skill after the effective date of the revised Agreement constitutes acceptance of the terms.
- Termination: Your rights under this Agreement will automatically terminate without notice if you fail to comply with any of its terms. In case of such termination, we may immediately revoke your access to the Skill.
- Tech Support: PSE&G may or may not provide technical and other support for the Skill. You agree to abide by any support rules and policies. If such support is provided, it will be provided in addition to any normal support for your Account(s) and will be available exclusively through the pilot while you are a participant.
- Disclaimer of Warranty: YOU ASSUME ALL RISK FOR YOUR USE OF THE SKILL, THAT IT IS PROVIDED “AS IS”, AND THAT PSE&G MAKES NO WARRANTY OR REPRESENTATION, EITHER EXPRESS OR IMPLIED. PSE&G EXPRESSLY DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM PSE&G, OR THROUGH OR FROM THE SKILL, WILL CREATE ANY WARRANTY OF ANY KIND.
- Governing Law; Jurisdiction; Venue: This Agreement shall be governed by and construed in accordance with the laws of the State of New Jersey without regard to any portion of its choice of law principles that might provide for application of a different jurisdiction's law; provided, however, that to the maximum extent permitted under applicable laws, this Agreement will not be subject to the Uniform Computer Information Transactions Act as currently enacted or as may be codified or amended from time to time by any jurisdiction. You irrevocably and unconditionally submit to the jurisdiction and venue of the United States District Courts for the District of New Jersey, or if such court does not have subject matter jurisdiction, to the courts of the State of New Jersey located in Essex County.
- Trademark Information: PSE&G trademarks and graphics used in connection with the Skill are the property of PSE&G. All other trademarks and graphics used are the property of their respective owners.
- Privacy and Security: The Skill allows you to use your Alexa-enabled device to communicate with PSE&G, by voice, regarding your Account(s). At PSEG, our goal is to give you as much control as possible over your personal information. In general, you can visit PSEG on the Site without telling us who you are or revealing any information about yourself. There are times now or in the future, however, when we may need information from you to provide the Services, such as your name, e-mail address, home address, bank account information and/or credit card information. Your information may be collected and/or processed directly by PSEG or indirectly through our third party service providers (“Providers”).
We use the information gathered from the forms you fill out on the Site or through the Services for the purpose it was provided, generally in one of four ways:
- To provide you with information about products, services, news and events;
- To allow you to use and/or purchase Services including certain products that we may offer from time to time;
- To allow you to pay your PSEG bills online, Automated Clearing House (ACH) transfers or other methods that we may offer from time to time; and
- To gather broad, aggregated demographic information about user trends.
We will only collect personal information to the extent deemed reasonably necessary to serve PSEG’s business purposes.

By accessing or using the Site, you are consenting to our use of cookies as described below. “Cookies” are small amounts of text-only data that is stored on your computer or other device you use to access the Internet to allow the Site to remember information that will make your use of the Site more convenient. For example, the Site may use cookies to recall data so you do not have to retype the data. We may use both session cookies and persistent cookies. Session cookies are temporary cookies that remain in the cookie file of your browser until you leave the Site. Persistent cookies are stored on your computer’s hard drive for much longer. You can manage and delete cookies that have been installed in the cookie folder of your browser by following the instructions provided by the developer of your browser. Please note that if you do not accept these cookies, you may experience some inconvenience when using the Site or our Services. For example, we may not be able to recognize your computer and provide personalized content.
We may also use invisible pixels or beacons on this Site to count how many users visit certain pages, track the actions of users of the Services and measure the success of our marketing campaigns.

We use commonly available security techniques to protect against the loss, misuse, and unauthorized access, disclosure, alteration, or destruction of information under our control. Your personally identifiable information (such as an account number or credit card information), is protected from unauthorized access using commercially reasonable measures. Please understand, however, that no security system is impenetrable and we cannot guarantee security. Remember that we have no control over transmittals or transactions that do not occur on PSEG systems or networks, including transmittals to and from the Site over the Internet including via email. All forms on our Site are totally voluntary. If you do not feel comfortable submitting information over the Internet, please call a customer service representative at (800) 436-7734.
Your account on the Site or any separate account that may be created to access the Services is also protected by a Log-In, Password and Unique Identifiers (your “Credentials”) which you create. You should not disclose your Credentials to anyone and you should always remember to log off the Site or the Services when finished, especially if using a shared computer. You are solely responsible for maintaining the confidentiality of your Credentials, and for any use of your Credentials, whether or not you have authorized such use.
You acknowledge and agree that we assume no liability regarding theft, loss, alteration, or misuse of information, including, without limitation, such information that has been provided to third parties or other users, or with regard to the failure of a third party to abide by the agreement between us and such third party.

PSEG will not disclose any of your personal information without your consent, except in the following situations:
- To help establish programs in which municipalities buy energy on behalf of their residents;
- To initiate, render, bill and collect for electric and/or gas services;
- In connection with the administration of a Board of Public Utilities approved energy efficiency or renewable energy (such as solar energy) program or Board of Public Utilities approved appliance maintenance or repair services;
- To protect consumers from fraudulent, abusive, or unlawful behavior, or to protect PSEG’s rights or property;
- In the event of a corporate, business, or asset sale, merger, reorganization, dissolution or similar event, your information may be included in the transferred assets;
- In connection with surveys and contests (see below);
- To send you information regarding PSEG and our products and services, and promotional materials from some of our Providers;
- In connection with any non-encrypted data you provided to the Site or in connection with the Services, this non-encrypted data may be monitored and information may be disclosed to the U.S. Government to protect PSEG’s network from unauthorized usage or penetration; and
- If required to do so by law, such as in response to court orders and legal process.
When we engage a Provider to perform a business function, we only provide them with the information that they need to perform their obligations, and access to customer data is limited to those who specifically need it to conduct their business responsibilities.

PSEG may anonymize and aggregate your personal information and provide it to our existing or potential business partners, sponsors, advertisers or other third parties, in response to a government request, or to other third parties for lawful purposes.
PSEG servers also automatically gather non-personal information about our users including, but not limited to, the websites our customers visit on the Internet, pages visited within a PSEG Site, IP address, browser type and language, number of links you click while on the applicable site, search terms, operating system, website traffic, keywords and/or other data. PSEG may use this information for PSEG’s business purposes and may disclose such information to Providers performing services for us.

PSEG may ask for information from users via surveys or contests. Participation in these surveys or contests is completely voluntary and the user therefore has a choice whether or not to disclose this information. Information requested may include contact information (such as name and shipping address), and demographic information (such as zip code, age level). Contact information will be used by PSEG and Providers to administer the survey and/or contest, to notify the winners, and award prizes. Survey information will be used for purposes of monitoring or improving the use and satisfaction of this Site and the Services. We may use contact data from our contests to send users information about PSEG and promotional material from some of our third party business partners. Users may opt-out of receiving future marketing communications.

User Generated Content (as defined in the Terms of Use) is not confidential, may be made public by PSEG in its sole discretion subject to applicable law, and is not subject to the protections afforded personal information under this Privacy Policy.

PSEG: PSEG may send users legally required notifications and certain other communications including, but not limited to, service related notices, or transactional matters related to the Services and/or your account. For example, we may send you a notice regarding server problems or scheduled maintenance to the Site. In order to opt-out of receiving these notices, you may need to deactivate your account.
PSEG offers you control over your privacy preferences regarding direct marketing and promotional communications (via email, by mail, or by telephone). You may update these preferences at any time. Please allow sufficient time for your preferences to be processed.
- You may opt out of receiving direct marketing and promotional communications (via email, by mail, or by telephone) from PSEG by contacting customer service at (800) 436-7734. If you opt-out, PSEG will not contact you directly with marketing messages about PSEG services and/or products.
- When you receive a promotional e-mail from PSEG, it will contain a link that allows you to unsubscribe. If you decide to use this opt-out link, you will no longer receive promotional email, but you will continue to receive non-promotional e-mails and direct mail from us, such as order confirmations.
Third Parties: PSEG also offers you control over your privacy preferences regarding direct marketing and promotional communications (via email, by mail or by telephone). If you wish to opt-out of PSEG sharing your personal information with third parties for their own and third party direct marketing purposes (via email, by mail or by telephone), please contact customer service at (800) 436-7734.
